By entering SonicAwareness’ Online sales program, you hereby authorize SonicAwareness to sell your items (e.g. CDs, DVDs, Vinyl Records, T shirts,2 Stickers, etc.) from its online shop on a non-exclusive basis. Furthermore, you agree to provide SonicAwareness with your items at your expense, and that these items will be stored and maintained in SonicAwarenss’ facilities.
Any musician member may take part in SonicAwareness’ online sales program. There is no set up fee for Full, Advanced, or General Promotional Service Members. Musicians who do not have Full, Advanced, or General Promotional Service Memberships must pay a set up fee of $17.99 in order for their items to appear in the online shop. This fee is non-refundable once the item is placed in the shop.
Musicians taking part in this program may sell the following items via SonicAwareness’ Shop:
CDs
Vinyl Records
DVDs
Other merchandise (i.e. T shirts, Hats, Stickers, etc.) Pending Approval
All items must be owned by the musician(s) submitting the items, including all artwork, copyrights, trademarks and other property rights. YOU MAY NOT SUBMIT ITEMS THAT DO NOT BELONG TO YOU. THIS ALSO APPLIES TO LOGOS AND OTHER FORMS OF INTELLECTUAL PROPERTY. SONICAWARENESS ACCEPTS NO RESPONSIBILITY SHOULD YOUR PRODUCT VIOLATE COPYRIGHT LAW OR THE RIGHTS OF THIRD PARTIES, AND YOU AGREE TO INDEMNIFY AND COMPENSATE US FOR ANY EXPENSES OR CLAIMS THAT ARE MADE AGAINST SONICAWARENESS IF YOU VIOLATE THE PROVISIONS OF THIS PARAGRAPH OR THE PROPERTY RIGHTS OF ANY THIRD PARTY.
There is no limit to the number of different items you may sell in our shop. However, SonicAwareness reserves the right to decide which items it will and will not sell at any time.
The items you submit may not incite hatred, and may not be slanderous in any way, degrade any person or group of persons, and may not be offensive or unsafe in any way, as determined by SonicAwareness in its sole discretion.
Any rejected items will be returned to you at your expense.
You are responsible for providing SonicAwareness with the items intended for sale in the Shop. Seller is required to provide 5 units of each item before SonicAwareness places these items up for sale. Shipping costs and arrangements are the sole responsibility of the seller. We are not responsible for any damage that occurs during or as the result of shipping.
In accepting your items, SonicAwareness will perform a routine inspection to ensure an acceptable degree of quality. However, we will not conduct a thorough inspection of your items for sale. Therefore, you are responsible for any defects inherent in the products themselves that are not immediately visible upon basic inspection. This includes problems in recordings such as "skips", and other production problems such as picture quality and craftsmanship. By sending us your items and agreeing to this contract, you hereby certify that the products you send are “complete” in their form, and are not missing any essential parts or materials. You also certify that all items are in “working condition”, meaning they can function as they are supposed to function under normal use. If your product is sold, and is later found to be defective, SonicAwareness reserves the right to charge you for the sale of the defective product. In the event that you have already been compensated for the sold product, SonicAwareness may either bill you in order to redeem the invalid earnings, or withhold future earnings equal to the amount distributed as a result of the sale of the damaged item.
You will provide us with an accurate description of your product. This includes such things as song titles, viewing titles, sizes, weights, instructions required in use, contents, and so forth.
You will set the selling price for your items. However, no item may be listed for sale at less than the commission charged by SonicAwareness as noted below. Price shall not include taxes or shipping, which will be paid for by the consumer in addition to the purchase price.
SonicAwareness charges a commission on all items sold in its shop. Commissions are based on the following rates
For every CD sold, SonicAwareness collects a flat fee of $3.50
For every DVD sold, SonicAwareness collects a flat fee of $3.75
For every Vinyl record sold, SonicAwareness collects a flat fee of $4.00
For all other items (i.e. shirts, stickers, posters, etc.) SonicAwareness will charge a 20% commission on the sale price, not including the cost of shipping, but in any case a minimum of $3.00. Therefore, if you sell a t shirt for $25, SonicAwareness will charge a commission of $5.00. Commissions will be subject to sales and value added taxes where required by local laws.
All shipping charges are kept by SonicAwareness. You are not entitled to any portion of the shipping charge.
Once commissions are deducted, the rest belongs to you the musician. Therefore, if you sell a CD for $12.50, SonicAwareness will charge $3.50 in commissions, and you’ll earn $9.00, with the customer paying the shipping costs and taxes.
Musician earnings are sent out on the 15th of each month, and are based on the previous month’s totals. Earnings are sent via PayPal only. For example, earnings sent out on the June 15th are based on earnings for the month of May. SonicAwareness will not send out a musician’s earnings if the earnings are less than $10.00.
Your items will be listed in the shop, whether they are in stock or not. If your item sells out, we will post a “Temporarily Out of Stock” message next to your item in the shop. We will also a request link so customers interested in your product may send us a request. We will notify you right away when your item sells out. You do not have to restock your item immediately as you may wait for a request to be made for your item (although we encourage you to send additional items the moment they sell out). If an item listed in our online shop remains out of stock for more than 60 days though, we will remove the item from the online shop until such time as you re-supply us with the item that was posted.
Any items sent to us will be stored in our warehouse until it is sold or you request its return or we decide to return the items to you. Termination of musician membership with SonicAwareness will not result in your items being returned automatically. You must request the return of these items yourself. We will return your items upon your request, and you will be responsible for covering all shipping and handling charges prior to us physically shipping the items to you. As long as your items are stored in our facilities they will remain available for sale in our online shop. If you want your items removed from the shop, then we will cease to store your items in our facilities, and your items will be returned to you and you will be responsible for the shipping cost. In addition, SonicAwareness may elect in its discretion to return any items to you at your expense at any time. If you refuse to accept the return of your items, having requested that we no longer sell them in our shop, we will dispose of your items in such manner and under such terms as we see fit.
Before approaching any webmaster for a link exchange, check and see if you have at least 10-20 quality links pointing to your website. So, a link exchange, could boost search engine rankings for both parties, and improve page rank. This is why a webmaster will not approve a link exchange request, until you have at least 10-20 inbound links and a few good posts or articles.
